Terms
Terms of use
Effective 2026-11-05
Draft prepared for attorney review.
Effective date: November 5, 2026
These Terms of Use are an agreement between you and Poppy Surrogacy ([[PLACEHOLDER: legal entity name]]). In these terms, "Poppy," "we" and "us" mean Poppy Surrogacy, and "you" means anyone who uses our website at [[PLACEHOLDER: website domain]], including our pre-screens and applications.
By using our website, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the website.
Who we are
Poppy is an egg donation and surrogacy agency based in Pacific Palisades, California. We recruit and screen egg donors and surrogates, match them with intended parents and coordinate the process.
We are not a medical provider, a law firm, an escrow company or an insurance company. Medical care is provided by licensed clinics and doctors. Each party has their own independent lawyer. Funds are held by an independent escrow company.
Eligibility
You must be at least 18 years old to use our website. Our programs have their own requirements:
- Egg donors must be between 21 and 31 years old and meet the medical and screening requirements of Poppy and the treating clinic.
- Surrogates must be between 21 and 42 years old, have had at least one prior healthy, full-term pregnancy and meet the medical and screening requirements of Poppy and the treating clinic.
- Intended parents must meet the requirements we publish when matching opens [[PLACEHOLDER: intended parent requirements]].
We may change program requirements at any time.
Pre-screen results are not an offer
Our pre-screen gives you an early sense of whether a program may be a fit. It is based only on your answers.
A pre-screen result is not an offer, an acceptance into a program or a promise of any kind. Final eligibility depends on a full application and on screening by Poppy, the treating clinic, mental health professionals and others. We may decline an application at any stage, consistent with the law.
No guarantee of a match or outcome
We work hard to make good matches. But we cannot guarantee that:
- You will be matched, or matched within any time frame.
- A match will lead to an embryo transfer, a pregnancy or a birth.
- Any medical procedure will succeed.
Any timeline we share is an estimate, not a promise.
Your information must be accurate
You agree to give us true, complete and current information, and to update us if anything changes. This matters for your safety and for everyone involved in a match.
If you give us false or misleading information, or leave out important information, we may decline your application or end your participation in a program. We may verify information you give us, with your authorization where the law requires it.
Acceptable use
You agree not to:
- Use the website for any unlawful purpose.
- Submit an application on behalf of someone else without their permission.
- Pretend to be another person or misrepresent who you are.
- Upload content that you do not have the right to share, or that is unlawful, harmful or offensive.
- Try to access accounts, data or systems that are not yours.
- Interfere with the website's security or normal operation, or upload malicious code.
- Use automated tools to scrape, copy or collect information from the website.
- Contact applicants, donors, surrogates or intended parents through information you obtain from the website without their consent.

Other agreements come first
If you take part in a program, you will sign separate agreements, such as an agency agreement, a surrogacy agreement or an egg donor agreement. If those agreements conflict with these terms, those agreements control.
Not legal or medical advice
The content on our website, including our resource articles, is general information. It is not legal, medical, psychological, tax or financial advice. Reading it does not create a lawyer-client or doctor-patient relationship. Laws and medical guidance change, and every situation is different. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the website will always be available, error-free or secure.

Some laws do not allow these limits. If those laws apply to you, some of these limits may not apply.
This section covers your use of the website. Liability related to a program is governed by the separate agreements you sign.
Indemnity
You agree to defend and hold Poppy harmless from claims, losses and costs, including reasonable lawyers' fees, that arise from your misuse of the website, your breach of these terms or false information you submit.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute about these terms or the website will be resolved in the state or federal courts located in Los Angeles County, California, and you agree to their jurisdiction. [[PLACEHOLDER: attorney to decide whether to add an arbitration clause or class action waiver.]]
Ending your use
We may suspend or end your access to the website at any time if you break these terms. You may stop using the website at any time. Sections that by their nature should continue, such as intellectual property, disclaimers and limits of liability, will continue after your use ends.
Changes to these terms
We may update these terms. We will post the new version here with a new effective date. If you keep using the website after a change, you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these terms, we have not waived our right to enforce it later. These terms and our Privacy Policy are the full agreement between you and Poppy about the website.
